    Un CTD est un contrat d\u00e9finissant la mani\u00e8re dont les parties doivent g\u00e9rer les donn\u00e9es personnelles ou les donn\u00e9es permettant l\u2019identification personnelle. Il d\u00e9finit les param\u00e8tres entre les parties concernant la mani\u00e8re dont un Sous-traitant doit traiter les donn\u00e9es au nom du Responsable du traitement. Trackunit s\u2019assure que les CTD fournis r\u00e9pondent aux exigences telles que d\u00e9finies par le Comit\u00e9 europ\u00e9en de la protection des donn\u00e9es (CEPD) et le R\u00e8glement g\u00e9n\u00e9ral sur la protection des donn\u00e9es (RGPD). Les CTD standard de Trackunit doivent \u00eatre \u00e9tablis entre vous, en tant que client, et Trackunit, en tant que votre Sous-traitant de donn\u00e9es, si vous \u00eates situ\u00e9 dans l\u2019UE ou dans un pays tiers s\u00fbr, tel que d\u00e9fini par le CEPD.     Les CCT sont des contrats standard \u00e9tablis par le CEPD qui ne peuvent pas \u00eatre modifi\u00e9s, \u00e0 utiliser entre les Responsables du traitement et les Sous-traitants si vous \u00eates situ\u00e9 en dehors de l\u2019UE ou d\u2019un pays tiers s\u00fbr tel que d\u00e9fini par le CEPD. Le r\u00f4le des CCT est d\u2019assurer un niveau appropri\u00e9 de protection et de garantie des donn\u00e9es pour les transferts internationaux de donn\u00e9es entre un Responsable du traitement et un Sous-traitant ou entre deux Sous-traitants ou deux Responsables du traitement. Toutes les CCT pr\u00e9sent\u00e9es ici ont \u00e9t\u00e9 actualis\u00e9es conform\u00e9ment aux nouvelles directives du CEPD en respectant l\u2019arr\u00eat Schrems II.

    Un Responsable du traitement est d\u00e9fini dans le RGPD comme une personne (juridique ou autre) qui, seule ou avec d\u2019autres, d\u00e9termine les buts et moyens de traitement des donn\u00e9es personnelles. Dans le contexte de Trackunit, si vous \u00eates le propri\u00e9taire des donn\u00e9es collect\u00e9es \u00e0 partir de l\u2019\u00e9quipement sur lequel nos bo\u00eetiers sont plac\u00e9s, vous \u00eates d\u00e9fini comme un Responsable du traitement. Veuillez garder \u00e0 l\u2019esprit que vous pouvez convenir d\u2019\u00eatre co-responsable du traitement avec l\u2019entit\u00e9 aupr\u00e8s de laquelle vous avez achet\u00e9 les bo\u00eetiers si vous ne les avez pas directement achet\u00e9s aupr\u00e8s de Trackunit. Ceci sera d\u00e9fini dans votre contrat avec cette entit\u00e9. Dans le contexte de Trackunit, cela signifie que si vous avez plac\u00e9 nos boitiers sur un \u00e9quipement et vendu cet \u00e9quipement, vous \u00eates tr\u00e8s probablement un Sous-traitant. Trackunit is committed to provide state of the art cyber security and data protection. We believe privacy is about freedom and being able to decide for your-self how your data is used and by whom. This is why we have established our Privacy Principles:<\/p>

    This Notice may be amended or updated from time to time to reflect changes in our practices or applicable law. We encourage you to check this page regularly for updates.<\/p>

    We are committed to the following principles in how we handle your data:<\/strong><\/h3>

    Trackunit processes Personal Data in accordance with the following core principles.<\/p>

    Transparency.<\/strong> Data subjects are kept fully informed of which Personal Data are processed, the purposes for which they are processed, the period for which they are retained, and the parties who may access them. Trackunit does not use Personal Data for purposes beyond those for which it was collected or provided, unless a separate legal basis applies.<\/p>

    Purpose limitation.<\/strong> Personal Data are collected for specified, explicit and legitimate purposes and are not further processed in a manner incompatible with those purposes.<\/p>

    Data security.<\/strong> Appropriate technical and organisational measures are implemented to protect Personal Data against unauthorised access, accidental loss, destruction or damage. These measures include, where appropriate, encryption, anonymisation and pseudonymisation.<\/p>

    Data minimisation.<\/strong> Only Personal Data that are adequate, relevant and limited to what is necessary in rela-tion to the purposes for which they are processed are collected and retained. Retention periods are kept to the minimum necessary.<\/p>

    Individual rights.<\/strong> Data subjects may, subject to applicable law, access, correct, delete or port their Personal Data, and withdraw any consent previously given, in accordance with the procedures set out in this Notice.<\/p>

    Lawful disclosure.<\/strong> Personal Data are shared with third parties only in accordance with this Notice or as re-quired or permitted by applicable law. Data subjects are informed of such sharing in accordance with appli-cable transparency obligations.<\/p>

    Legal compliance.<\/strong> Trackunit applies the General Data Protection Regulation (GDPR) as its baseline standard for the processing of Personal Data globally, irrespective of the jurisdiction in which processing takes place.<\/p>

    Trackunit as a Data Processor<\/h3>

    In connection with the delivery of our Products and Services to customers, Trackunit acts in the capacity of a data processor.<\/p>

    If you interact with equipment connected to the Trackunit platform by virtue of an employment relation-ship or through the arrangements of a third-party fleet owner, you are encouraged to direct any enquiries regarding the processing of your personal data in that context to the relevant organisation.<\/p>

    We will always keep you fully informed about your data.<\/h3>

    We make sure you understand which data from or about you we use, why we use it, how long we use it and who can use it. We enable you to remain in control of your data. We consider the data from or about you to be yours. We only use it for the purposes for which you have given it to us, or for which we collected it from you. Trackunit is the data processor and processes data on behalf of the data controller in accordance with the General Data Protection Regulation in the EU. Trackunit shall act only on instructions from you.<\/p>

    What Personal Data We Collect<\/h3>

    The Personal Data we collect depends on which of our Products, Services, and Sites, or other services you use, and how you use them. In general, the data we collect falls into the following categories.<\/p>

    Data you provide to us<\/strong> encompasses all information you enter or submit directly . This includes personal and contact details such as your name, email address, telephone number and postal address; account and registration information; search terms and preferred or frequently used locations; and any feedback, error reports or other content you choose to submit to us.<\/p>

    Data collected through hardware arises when you install or use our Products and Services that run on, or interface with, sensor-equipped devices. Many of our products are equipped with, or make use of, one or more sensors, including GPS receivers, Wi-Fi and Bluetooth receivers, G-force sensors, and touch-sensitive screens. When activated, these sensors collect data automatically. Depending on the purpose for which it is captured, this data, in combination with data that identifies you or your device, may be transmitted to Trackunit for subsequent processing. In the case of our Products, this includes telemetry and operational data such as location (latitude\/longitude), speed, heading, number of kilometres travelled, hours of use, and status of inputs and outputs. Where activated at your request, it may also include operator identifica-tion data, fuel usage and hydraulic oil temperature.<\/p>

    Metadata and automatically generated data<\/strong> are collected or generated inherently through your use of a computing device or through the transmission of data over computer networks such as the internet. This category includes user interface and device usage events, IP addresses, unique device identifiers, Wi-Fi and Bluetooth MAC addresses, cookies and records of activity on our Services. For further details about our use of cookies, please see the section below relating to Cookies in this Notice.<\/p>

    Trackunit does not sell or disclose data. However, Trackunit have the right to analyze and disclose market statistics which, among other sources are based on anonymous operating data from Trackunit Hardware. Where Personal Data is used for analytical purposes, Trackunit processes only aggregated and anonymized data that cannot reasonably be used to identify any individual. Trackunit may publish market statistics and industry benchmarks derived from such anonymized operational data.\u00a0\u00bb<\/p>

    Your Sensitive Personal Data<\/h3>

    Trackunit does not seek to collect or process Sensitive Personal Data in the ordinary course of its business. If processing of Sensitive Personal Data becomes necessary, this is carried out only where required or permit-ted by applicable law or where necessary for the detection or prevention of crime, such as fraud prevention. Sensitive Personal Data may also be processed where necessary for the establishment, exercise or defence of legal claims, or where you have given your express prior consent, which is relied upon only for processing that is entirely voluntary in nature.<\/p>

    Our Products and Services are not directed at children. Trackunit does not knowingly collect Personal Data from children below the relevant minimum age in any jurisdiction.     How we use your Personal Data<\/h3>

    The section sets out the purposes for which Trackunit processes Personal Data, together with the legal basis on which each processing activity rests. Where applicable law requires a legal basis for processing, Trackunit relies on one or more of the bases described below. For US residents please refer to US specific Disclosure section on information about your rights under applicable US law in this Privacy Notice.<\/p>

    Personal Data is processed to provide our Products and Services, relying on contract performance, our legit-imate interest in providing those services, or consent where processing is voluntary. This includes personal details, contact details, correspondence, consent records, purchase and payment details, platform and device data, cookie data.<\/p>

    Surveys and feedback activities, together with ongoing efforts to improve Products and Services, are carried out on the basis of legitimate interest or consent when voluntary. For these purposes we process personal details, contact details, correspondence, demographic data, consent records, platform and device data, content and advertising data, and views and opinions. The physical and electronic security of our business and premises, including visitor logs, login records and access details, is maintained on the basis of legal ob-ligation or our legitimate interest in ensuring a safe and secure environment, using personal details, contact details and visitor logs for that purpose.<\/p>

    Security processing, including physical and electronic security of our premises, CCTV recordings, login rec-ords and access details, is carried out on the basis of legal obligation or legitimate interest in ensuring the security of our business and premises. Investigations into potential breaches of our policies or applicable laws are carried out on the basis of legal obligation or legitimate interest in detecting and protecting against such breaches. Legal compliance processing rests on legal obligation or legitimate interest in complying with regulatory requirements or guidance.<\/p>

    Who We Share Your Personal Data With<\/h3>

    Personal Data may be shared with other entities within the Trackunit group where necessary for legitimate business purposes. Beyond intra-group disclosures, we may share Personal Data with the following catego-ries of recipients:<\/p>

    Your appointed representatives, where applicable; professional advisors, including accountants, auditors, consultants and lawyers, who are subject to binding confidentiality obligations; and third-party processors, such as payment service providers, cloud hosting providers, CRM and analytics services, and other technol-ogy providers, who are contractually required to process Personal Data solely in accordance with docu-mented instructions and to maintain appropriate technical and organisational security measures.<\/p>

    We may further disclose Personal Data to regulatory bodies, governmental authorities, law enforcement agencies or courts where required by applicable law or where necessary for the establishment, exercise or defence of legal claims, as well as to third-party acquirers or successors in title in connection with any sale, merger, reorganisation, dissolution or liquidation of all or part of our business.<\/p>

    We do not sell your Personal Data to third parties.<\/p>

    International Transfers<\/h3>

    Because of the international nature of our business, Personal Data is transferred within the Trackunit group and to third parties in countries other than your own. Some of these countries may not provide the same level of data protection as the country in which you are located.<\/p>

    Where Personal Data is transferred from the EEA to recipients in countries that have not been recognised as providing an adequate level of protection, such transfers are carried out using Standard Contractual Clauses approved by the European Commission.<\/p>

    Where you directly transfer Personal Data to a Trackunit entity established outside the EEA, we are not re-sponsible for that initial transfer. We will, however, process your Personal Data in accordance with this Notice from the point of receipt.<\/p>

    We protect your data<\/h3>

    Your data is yours. We keep it that way by protecting it as best as we reasonably can to prevent it from fall-ing into the wrong hands. We do this through encryption, anonymisation, or pseudonymisation of your data. This way we keep your data safe. We will tell you which data from or about you we use, why we use it, how long we use it, who else can use it and where it is kept. We will only use your data for the purposes we have stated to you. We keep as little of your data as possible, and only for as long as we need it. When we no longer need data we destroy it or we irreversibly anonymise it, so it is no longer linked to you. If we ask your permission to use your data for specific purposes, we also always allow you to withdraw your permission. We will allow you to access and correct your data if it is linked to your Trackunit Applications. We will keep protecting your data against unauthorized access and accidental loss as best as we reasonably can. If we engage others to use your information on our behalf, we will ensure they act in accordance with our poli-cies.<\/p>

    If we share your data with others, we will first ask you for permission, unless there is a legal obligation that prohibits us from asking. We are open to any questions you may have about how we use your data and we will answer them. We operate according to the privacy laws applicable in your country. Because we are rooted in Europe, the General Data Protection Regulation is always in effect. These laws are considered to be the most extensive in the world. They offer a high level of protection to you by only allowing us to use your data when the strict conditions of these laws are met. Our company policy on privacy and processing of personal data reflects these laws and we apply this policy globally.<\/p>

    Please be aware that because the internet is an open system, the transmission of information online is not completely secure. While every reasonable measure is taken to protect your Personal Data in transit, the security of data transmitted to us over the internet cannot be fully guaranteed. Any such transmission is made at your own risk.<\/p>

    Data Quality, Minimisation and Retention<\/h3>

    Every reasonable step is taken to ensure that your Personal Data is accurate and, where necessary, kept up to date, and that any inaccurate Personal Data is erased or rectified without delay. From time to time, we may ask you to confirm the accuracy of your Personal Data. We also take every reasonable step to ensure that the Personal Data we process is limited to what is reasonably necessary in connection with the purposes set out in this Notice.<\/p>

    Your Personal Data is retained in a form that permits identification only for as long as we maintain an ongo-ing relationship with you, for example, where you are a named contact at a customer or vendor organisa-tion or you are subscribed to our mailing list, or your Personal Data is necessary in connection with a lawful purpose for which we have a valid legal basis. We then retain Personal Data for the duration of any applica-ble limitation period under applicable law, plus an additional two months, and for any further period nec-essary in connection with live legal claims. During those additional periods, our processing is restricted to storage of, and maintaining the security of, those data, except to the extent they need to be reviewed in connection with a legal claim or obligation under applicable law. Once retention is no longer required, we will either permanently delete or anonymise your Personal Data.<\/p>

    Subject to applicable law, you have a number of rights regarding the processing of your Personal Data. You have the right of access to request copies of your Personal Data together with in-formation about how it is processed, and the right to rectification of any inaccuracies in your Personal Da-ta.<\/p>

    You have the right to erasure or restriction to request, on legitimate grounds, deletion of your Personal Data or restriction of its processing, and the right to data portability to have certain Personal Data trans-ferred to another controller in a structured, commonly used and machine-readable format. Where we pro-cess your Personal Data on the basis of your consent, you have the right to withdraw that consent at any time without affecting the lawfulness of processing carried out prior to that withdrawal.     Trackunit Account<\/h3>

    Your Trackunit account is used to provide you with access to downloadable content, subscribed or activat-ed services, software upgrades and areas of our Sites that require registration. It is also used to facilitate purchases of additional products and services and to personalise our offerings to you. The specific ways in which your account is used may vary depending on the software, device or system you use.<\/p>

    We may use the email address associated with your Trackunit account to send you information relating to the products and services registered to that account. Such communications are limited to updates neces-sary to ensure the safe, reliable and uninterrupted use of your product, or where we are required to contact you by applicable law.<\/p>

    Your Trackunit account details are not shared with third parties except where those parties process data on our behalf and under our instructions, or where we are required to do so by a lawful legal obligation follow-ing due process.

    Definitions<\/h3>

    Access:<\/em> The Customer decides the account administrator managing the access to the data collected from the installed tracking device. Any authorised user can only see the data to which access has been granted by the account administrator, i.e. either all machines in the fleet or only selected machines. We always have the opportunity to access and correct your data on your behalf Access by Trackunit is limited to employees that need to have access to provide our services.<\/p>

    Customer:<\/em> The Customer is either the end-customer, contractor, rental company, distributor or OEM (ei-ther data controller or data processor).<\/p>

    Data Controller:<\/em> The Data Controller is the end-customer owning the equipment in which tracking devices have been installed.<\/p>

    Data Processing Agreement:<\/em> Trackunit has taken precautions to make certain that the Customer complies with the requirements in the GDPR and uploaded a Data Processing Agreement (DPA) and Standard Con-tractual Clauses, which can be downloaded in different language versions: https:\/\/www.trackunit.com\/company\/privacy\/<\/a>.<\/p>

    Data Subjects:<\/em> The Data Subjects are the operators of the end-customer\u00b4s equipment in which tracking de-vices have been installed.<\/p>

    Personal Data:<\/em> any information relating to an identified or identifiable natural person (‘Data subject’, user); an identifiable person is one who can be identified, directly or indirectly, in particular by reference to an identification number or to one or more factors specific to his physical, physiological, mental, economic, cultural or social identity.<\/p>

    Processing of Personal Data \u2018processing’:<\/em> any operation or set of operations which is performed upon Per-sonal Data, such as collection, recording, organization, storage, adaptation or alteration, retrieval, consul-tation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combi-nation, blocking, erasure or destruction.<\/p>

    Purpose of Processing:<\/em> Trackunit Processes Personal Data only for purposes that are necessary in order for Trackunit to provide fleet management and telematics. Further, Trackunit may aggregate and\/or anonymize Personal Data and Process such aggregated or anonymized data for statistical purposes, innovated devel-opment and benchmarks.<\/p>

    Return or Deletion:<\/em> In the event of the termination of the cooperation, the Customer is entitled to deter-mine the media format to be used by Trackunit when returning the Personal Data and to determine if Per-sonal Data should instead be deleted. If you choose to have the data deleted, please be aware that the data Trackunit is processing on your behalf, may be required in relation to other legislation and when fully delet-ed the data cannot be recovered again, and could put you as a Customer at risk of not complying with safety and similar regulations.<\/p>

    Storage:<\/em> Trackunit stores data from the tracking devices on the clouds from Amazon Web Services. The Cus-tomer decides how long Personal Data shall be stored.<\/p>

    Additional Privacy Disclosures for US Residents<\/h3>

    This US-specific section applies exclusively to residents of the United States. It supplements, and should be read together with, the main body of this Privacy Notice. In the event of any conflict or inconsistency be-tween the US specific section and the main body of this Privacy Notice, the provisions of this US section shall prevail to the extent applicable to US residents.<\/p>

    This additional section provides the disclosures required under applicable US state privacy law, including the California Consumer Privacy Act of 2018 (\u201cCCPA\u201d), as amended by the California Privacy Rights Act of 2020 (\u201cCPRA\u201d).<\/p>

    We do not sell or share your information as those terms are defined under the CCPA. The limited exception applies to content and advertising data, cookie data, personal details, and contact details, where certain advertising and analytics cookies placed on our websites may constitute a \u00ab\u00a0sharing\u00a0\u00bb under California law. This occurs only through those cookies and solely for the purposes of digital advertising and analytics. All other categories of Personal Information we collect are not sold or shared.<\/p>

    \u201cCookie\u201d<\/strong> means a small file that is placed on your device when you visit a website (including our Sites). A reference to a \u201cCookie\u201d includes analogous technologies such as web beacons and clear GIFs.<\/p>

Sensitive Per-sonal Information also includes the processing of biometric information for the purpose of unique-ly identifying a consumer, and Personal Information collected and analysed concerning a consum-er\u2019s health, sex life or sexual orientation.<\/p>
